Toestemming voor de verwerking van persoonsgegevens in overeenstemming met de AVG - EU-verordening 2016/679. De gegevens die op het aanvraag- of boekingsformulier worden ingevuld, worden door Happy Bike alleen gebruikt voor het beantwoorden van vragen of reserveringen. De gegevens worden niet aan derden verstrekt.

Algemene verkoopsvoorwaarden

Clausule nr. 1: Object De hieronder beschreven algemene verkoopvoorwaarden beschrijven de rechten en plichten van Happy Bike en haar klant in het kader van de verkoop van goederen op de website happy-bike.it. Elke verkoopdienst uitgevoerd door het bedrijf Happy Bike impliceert daarom de onvoorwaardelijke aanvaarding door de koper van deze algemene verkoopvoorwaarden. Clausule nr. 2: prijs De prijzen van de verkochte goederen zijn de prijzen die gelden op de dag dat de bestelling wordt geplaatst. Ze zijn uitgedrukt in euro en berekend inclusief BTW. De transportkosten moeten op de dag van de bestelling worden toegevoegd. De transportprijs is afhankelijk van de afstand tot het afleveradres. Happy Bike geeft zich het recht om haar prijzen op elk moment te wijzigen. Happy Bike verbindt zich er echter toe om de bestelde goederen te factureren tegen de prijzen die zijn aangegeven bij de registratie van de bestelling. Clausule nr. 3: Betalingsvoorwaarden Bestellingen moeten worden betaald met creditcard, PayPal of bankoverschrijving. Let op: Bij gebruik van PayPal wordt een toeslag van 6% herberekend over de gehele factuur. De bestelling wordt pas geaccepteerd na ontvangst van de betaling. Clausule nr. 4: Annulering van de bestelling Happy Bike heeft het recht om een ​​bestelling op elk moment en zonder opgaaf van reden te annuleren. In dat geval wordt het volledige bedrag van de bestelling terugbetaald. De annulering van de bestelling kan geen aanleiding geven tot de winst van de koper bij de toerekening van een schadevergoeding. Clausule nr. 5: herroepingsrecht en terugbetaling Artikelen die op onze site worden verkocht, worden nooit terugbetaald. Als u de goederen niet meer wilt, kunt u deze binnen 14 dagen na acceptatie van de bestelling retourneren. Alle transportkosten zijn voor rekening van de koper. Op basis van de voorwaarden van het artikel en de verpakking, zal de verkoper een bedrag evalueren dat zal worden toegekend in de vorm van een tegoedbon die tijdens het boekjaar kan worden gebruikt in de Happy Bike-winkel in Riva del Garda. Clausule 6: Garantie Happy Bike is niet verantwoordelijk voor de garantie van de goederen. Als een garantie moet worden toegepast, dient de koper contact op te nemen met de fabrikant. Het is de fabrikant die de garantievoorwaarden beoordeelt aan de hand van de voorwaarden van de goederen. Clausule nr. 7: Levering en verzendtijden Bij niet-betaling worden de goederen niet verzonden. Levering vindt plaats door de goederen rechtstreeks bij de koper af te leveren in onze Happy Bike-winkel in Riva del Garda of op het adres dat de koper op het bestelformulier heeft aangegeven. De leveringstermijn die wordt aangegeven bij het registreren van de bestelling is slechts een indicatie en is geenszins gegarandeerd. Bijgevolg mag een redelijke vertraging in de levering van de producten er niet toe leiden dat de koper een schadevergoeding krijgt of de bestelling wordt geannuleerd. Het transportrisico is geheel voor de koper. In geval van ontbrekende of beschadigde goederen tijdens het transport, moet de koper bij ontvangst van de goederen alle nodige reserveringen maken op het bestelformulier. Deze klacht dient binnen 24 uur per e-mail aan Happy Bike te worden gemeld. Happy Bike is niet verantwoordelijk voor beschadiging, gedeeltelijk of totaal verlies van de artikelen en verpakking van de gekochte artikelen. Clausule nr. 8: Bevoegdheid Elk geschil met betrekking tot de interpretatie en uitvoering van deze algemene verkoopvoorwaarden is onderworpen aan de Italiaanse wetgeving. Bij gebrek aan een minnelijke schikking, moet het geschil tussen de partijen worden beslecht bij de bevoegde rechtbank onder Italiaanse jurisdictie in de provincie Trento (Italië).

General Conditions

1.The user declares to collect the bicycle and all the rented material in perfect operating and maintenance condition. Any deficiencies or damage found on delivery must be reported to the Happy Bike staff. 2.The use of the bicycle presupposes the physical fitness and the technical expertise of those who intend to lead it. Therefore, the user declares to be equipped with adequate capacity and appropriate competence to conduct a muscle or electric bicycle, without placing any reserve. 3.The bicycle is to be used exclusively as a means of transport. It is forbidden to transfer it in use to other subjects, participate in any competition and use for commercial activities. 4.The user is responsible for the assigned bicycles, identified by a number or color, from the time of pick-up to redelivery. The bicycle must be returned during the times indicated in this contract, in the same place where it was chartered. The bicycle is considered returned only if returned directly to Happy Bike. Parking the bicycle in front of Happy Bike during closing time does can not count as a return. Failure to return within the established time frame will be charged €10 per bicycle every 30 minutes late. Failure to return the bicycle without notice will be considered theft and will therefore be reported to the Judicial Authority. If the bicycle is not returned due to theft or abandonment, the cost of the bicycle will be charged according to the table of the rental contract. 5.The recovery of the bicycle is only possible on a paved road and will be charged € 50 + € 1 per km per bicycle. 6. The theft, replacement or tempering of bicycle components will be reported to the judical authority for having caused danger to the safety of others and the costs for restoring the components will be charged as on the table of the rental contract + maintenance cost. 7.The user is responsible for damage caused to the bicycle and equipment during use of the vehicle, assuming the burden of paying the sum necessary for the original restoration of the bicycle on the basis of the table shown in this contract. In the event that the use of electric city bikes or city bikes on unpaved paths is ascertained, a penalty quantified in € 100 will be charged. 8.In the event of theft or loss of the bicycle and its accessories, the user is obliged to report to the Competent Authority within 24 hours, assuming the responsibility to compensate Happy Bike on the basis of the table shown in this contract. 9.Happy Bike is exempt from liability for damages caused to themselves, to third parties and things during the use of the vehicle, and from unforeseeable or unavoidable events. No compensation can be requested at Happy Bike. 10.Happy Bike can check users during the use of bicycles and can ask for an anticipate return if the conditions of improper use of the vehicle is detected, and no refund will be done. Happy Bike may refuse to hire to people in a state of inebriation or under the influence of drugs (pursuant to Articles 186-187 of the Highway Code) and for other reasons at the unquestionable judgment of Happy Bike itself.11.The user must comply with all national road regulations when using the bicycle, including laws prohibiting the use under the influence of alcohol or other narcotic substances, or the use of earphones or a mobile phone while pedaling. The user is entirely and personally responsible for the payment of any infringement of the Italian road regulations, including the costs deriving from the sequestration and subsequent recovery of the bicycle. The responsible user will also be charged for the days that the bicycle is not available. 12.The user accepts the following conditions: A) The obligation to wear a protective helmet when using the bicycle. B) MTB bicycles are rented without lights. C) It is forbidden to modify the bicycle without Happy Bike authorization. D) It is forbidden to carry passengers on the bicycle, except in the case of a child in a special seat certified and approved by Happy Bike. E) It is forbidden to transport more than 10 kg on the rear rack. In case of use by minors, by signing this contract, the legal guardian or guardian of the minor accepts all the responsibilities specified in this contract and in the Civil Code and therefore authorizes the child to use the bicycle in the conditions specified by this regulation, made exception for paragraph 12-D. I accept and agree that this agreement is effective and binding on my heirs, close relatives, executors, directors and representatives, in the event of my incapacity or death. Risk assumption extends to and for people not listed in this contract and who take advantage of the rental service offered by Happy Bike, for which I sign and I assume all responsibilities, and that I inform about the contents of this. What is not mentioned in this regulation, the relationship between the parties (contractors) is governed by the Italian Civil Code. In case of lack of agreement between the parties (contractors), any dispute must be resolved at the competent court under Italian jurisdiction in the province of Trento.

Booking Conditions

The reservation will be confirmed only after payment of the entire fee and confirmation by Happy Bike by email.

Cancellations and Refunds

1.Cancellations will be considered valid only after confirmation by email by Happy Bike. 2.Refunds will be returned within a period between 2 and 4 weeks from the date of confirmation of the cancellation. 3.Happy Bike reserves the right to cancel a reservation and only in that case will be refunded the full amount paid. 4.There are no reimbursements in case the requirements of paragraph 2 of the General Conditions are missing or in case of cancellation due to illness or accident. 5.In case of adverse weather conditions, Happy Bike not make refunds of bookings.
