Consentement au traitement des données personnelles conformément au RGPD - Règlement UE 2016/679. La collecte des données personnelles et leur traitement se dérouleront conformément aux dispositions du RGPD - Règlement UE 2016/679. Les données saisies sur le formulaire de demande ou de réservation ne seront utilisées par Happy Bike que pour répondre aux questions ou réservations. Les données ne seront pas divulguées à des tiers.

Conditions générales de vente

Clause n° 1 : Objet Les conditions générales de vente décrites ci-après détaillent les droits et obligations de Happy Bike et de son client dans le cadre de la vente des marchandises sur le site happy-bike.it. Toute prestation accomplie par la société Haappy Bike implique donc l'adhésion sans réserve de l'acheteur aux présentes conditions générales de vente. Clause n° 2 : Prix Les prix des marchandises vendues sont ceux en vigueur au jour de la prise de commande. Ils sont libellés en euros et calculés TVA incluses. Des frais de transport sont à rajouter le jour de la commande. Le prix du transport varie en fonction de la distance de l'adresse de livraison. Happy Bike s'accorde le droit de modifier ses tarifs à tout moment. Toutefois, Happy Bike s'engage à facturer les marchandises commandées aux prix indiqués lors de l'enregistrement de la commande. Clause n° 3 : Modalités de paiement Le règlement des commandes s'effectue par carte de credit, par paypal ou par virement bancaire. Attention: Si vous utilisez PayPal une majoration de 6% sera recalculé sur la totalité de la facture. La commande est accepté seulement après réception du paiment. Clause n° 4 : Annulation de la commande Happy Bike à le droit d'annuler une commande à tout moment et pour aucune rasion précise. Si le cas se présente la totalité du montant de la commande vous sera remboursé. L'annulation de la commande pourra pas donner lieu au profit de l'acheteur à l'allocation de dommages et intérêts . Clause n° 5 : Droit de rétraction et remboursement Les articles vendu sur notre site ne sont jamais remboursé. Si vous ne désirez plus votre marchandise, vous pouvez nous le renvoyer à vos frais dans les 14 jours maximum qui suit l'acceptation de votre commande. Les frais de transport seront à charge de l'acheteur et en fonction de l'état de l'article et de son embalage, le vendeur evaluera un montant qui vous sera donné sous forme de bon d'achat utilisable durant l'année fiscale dans le magasin Happy Bike à Riva del Garda. Clause n° 6 : Garantie Happy Bike n est pas responsable de la garantie de la marchandise. Si une garantie doit etre appliqué, l'acheteur devra prendre contact avec le producteur. Celui-ci décidera des conditions de garantie selon l'état de la marchandise. Clause n° 7 : Délais de livraison et d'expédition En cas de défaut de paiement, la marchandise ne sera pas envoyé. La livraison est effectuée par la remise directe de la marchandise à l'acheteur dans notre magasin Happy Bike Riva del Garda ou au lieu indiqué par l'acheteur sur le bon de commande. Le délai de livraison indiqué lors de l'enregistrement de la commande n'est donné qu'à titre indicatif et n'est aucunement garanti. Par voie de conséquence, tout retard raisonnable dans la livraison des produits ne pourra pas donner lieu au profit de l'acheteur à l'allocation de dommages et intérêts et/ou l'annulation de la commande. Le risque du transport est supporté en totalité par l'acheteur. En cas de marchandises manquantes ou détériorées lors du transport, l'acheteur devra formuler toutes les réserves nécessaires sur le bon de commande à réception des dites marchandises. Ces réserves devront être, en outre, confirmées par email dans les 24 heures. Happy Bike n' est pas responsable pour la deterioration, la perte partielle ou totale des articles et emballages des articles achetés. Clause n° 8 : Tribunal compétent Tout litige relatif à l'interprétation et à l'exécution des présentes conditions générales de vente est soumis au droit italien À défaut de résolution amiable, le litige sera porté devant le Tribunal de commerce de Trento (Italie).

General Conditions

1.The user declares to collect the bicycle and all the rented material in perfect operating and maintenance condition. Any deficiencies or damage found on delivery must be reported to the Happy Bike staff. 2.The use of the bicycle presupposes the physical fitness and the technical expertise of those who intend to lead it. Therefore, the user declares to be equipped with adequate capacity and appropriate competence to conduct a muscle or electric bicycle, without placing any reserve. 3.The bicycle is to be used exclusively as a means of transport. It is forbidden to transfer it in use to other subjects, participate in any competition and use for commercial activities. 4.The user is responsible for the assigned bicycles, identified by a number or color, from the time of pick-up to redelivery. The bicycle must be returned during the times indicated in this contract, in the same place where it was chartered. The bicycle is considered returned only if returned directly to Happy Bike. Parking the bicycle in front of Happy Bike during closing time does can not count as a return. Failure to return within the established time frame will be charged €10 per bicycle every 30 minutes late. Failure to return the bicycle without notice will be considered theft and will therefore be reported to the Judicial Authority. If the bicycle is not returned due to theft or abandonment, the cost of the bicycle will be charged according to the table of the rental contract. 5.The recovery of the bicycle is only possible on a paved road and will be charged € 50 + € 1 per km per bicycle. 6. The theft, replacement or tempering of bicycle components will be reported to the judical authority for having caused danger to the safety of others and the costs for restoring the components will be charged as on the table of the rental contract + maintenance cost. 7.The user is responsible for damage caused to the bicycle and equipment during use of the vehicle, assuming the burden of paying the sum necessary for the original restoration of the bicycle on the basis of the table shown in this contract. In the event that the use of electric city bikes or city bikes on unpaved paths is ascertained, a penalty quantified in € 100 will be charged. 8.In the event of theft or loss of the bicycle and its accessories, the user is obliged to report to the Competent Authority within 24 hours, assuming the responsibility to compensate Happy Bike on the basis of the table shown in this contract. 9.Happy Bike is exempt from liability for damages caused to themselves, to third parties and things during the use of the vehicle, and from unforeseeable or unavoidable events. No compensation can be requested at Happy Bike. 10.Happy Bike can check users during the use of bicycles and can ask for an anticipate return if the conditions of improper use of the vehicle is detected, and no refund will be done. Happy Bike may refuse to hire to people in a state of inebriation or under the influence of drugs (pursuant to Articles 186-187 of the Highway Code) and for other reasons at the unquestionable judgment of Happy Bike itself.11.The user must comply with all national road regulations when using the bicycle, including laws prohibiting the use under the influence of alcohol or other narcotic substances, or the use of earphones or a mobile phone while pedaling. The user is entirely and personally responsible for the payment of any infringement of the Italian road regulations, including the costs deriving from the sequestration and subsequent recovery of the bicycle. The responsible user will also be charged for the days that the bicycle is not available. 12.The user accepts the following conditions: A) The obligation to wear a protective helmet when using the bicycle. B) MTB bicycles are rented without lights. C) It is forbidden to modify the bicycle without Happy Bike authorization. D) It is forbidden to carry passengers on the bicycle, except in the case of a child in a special seat certified and approved by Happy Bike. E) It is forbidden to transport more than 10 kg on the rear rack. In case of use by minors, by signing this contract, the legal guardian or guardian of the minor accepts all the responsibilities specified in this contract and in the Civil Code and therefore authorizes the child to use the bicycle in the conditions specified by this regulation, made exception for paragraph 12-D. I accept and agree that this agreement is effective and binding on my heirs, close relatives, executors, directors and representatives, in the event of my incapacity or death. Risk assumption extends to and for people not listed in this contract and who take advantage of the rental service offered by Happy Bike, for which I sign and I assume all responsibilities, and that I inform about the contents of this. What is not mentioned in this regulation, the relationship between the parties (contractors) is governed by the Italian Civil Code. In case of lack of agreement between the parties (contractors), any dispute must be resolved at the competent court under Italian jurisdiction in the province of Trento.

Booking Conditions

The reservation will be confirmed only after payment of the entire fee and confirmation by Happy Bike by email.

Cancellations and Refunds

1.Cancellations will be considered valid only after confirmation by email by Happy Bike. 2.Refunds will be returned within a period between 2 and 4 weeks from the date of confirmation of the cancellation. 3.Happy Bike reserves the right to cancel a reservation and only in that case will be refunded the full amount paid. 4.There are no reimbursements in case the requirements of paragraph 2 of the General Conditions are missing or in case of cancellation due to illness or accident. 5.In case of adverse weather conditions, Happy Bike not make refunds of bookings.
